1.End User License Agreement (EULA)

License Grant: Upon payment, you are granted a non-exclusive, non-transferable, Single-User License to use the WHALE X plugin for personal use only. Each License Key is valid for one (1) computer.

What You Receive: The WhaleXAudioActivator.exe installer and a License Key. Once you enter the License Key in the application, the plugin file (.dll) will be installed automatically.

Prohibited Actions: You may not copy, modify, distribute, resell, or reverse-engineer any files (.dll or .exe) associated with this software. If a violation is detected, we reserve the right to revoke your license immediately without prior notice and without a refund.

Intellectual Property: The WHALE X FPS Sound Enhancer software, including all code, graphics, trademarks, and website content, is the intellectual property of WHALE X AUDIO. It is protected under the Thai Copyright Act B.E. 2537 (1994) and applicable intellectual property laws.

2.No-Refund Policy

Because WHALE X is a digital product (Digital Goods) that can be copied once downloaded, all sales are final — no exchanges or refunds will be issued under any circumstances. Please review all product details, system requirements, and terms carefully before placing an order.

This policy is consistent with the Thai Consumer Protection Act, which exempts immediately delivered digital goods from return rights, as they cannot be restored to their original state.

3.Disclaimer

This software is designed to enhance audio quality through Equalizer APO. WHALE X AUDIO shall not be held liable for any damage to your hardware or software that may occur.

Use with Video Games: Although our plugin operates independently and does not modify any game files, you use it at your own risk. WHALE X AUDIO is not responsible if your account is suspended by a game's anti-cheat system.

4.Payment & Delivery Terms

Payment Methods: Payments are processed via QR PromptPay through Beam Checkout. WHALE X AUDIO does not directly store any credit card or financial information.

Delivery: After successful payment confirmation, you will receive the following items instantly via the website:

• WhaleXAudioActivator.exe — the installer and activation tool
• Lifetime License Key — yours forever, with no expiration

5.Privacy Policy

5.1 Data We Collect

• Account Information: email address, username
• Order Data: order number, selected package, payment date and time
• Device Information (Machine ID): Windows username used during license activation
• Website Usage Data: data collected via cookies (see Section 6)

5.2 Purpose of Data Collection

• To provide License Key services and verify usage rights
• To provide support and remote setup services
• To improve website performance and user experience

5.5 Your Rights (Under PDPA)
